1. Acceptance of Terms

By accessing or using the website moduletrace.org and any related services, applications, or products offered by Moduletrace LLC ("we," "us," or "our"), including but not limited to Circlenav, Datasquirel, Coderank, and Mediajury (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Services.

2. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you represent that you have your parent or guardian's permission to use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements.

3. User Accounts and Security

To access certain features of the Services (e.g., participating in Coderank contests, using Datasquirel dashboards), you may be required to create an account.

• Accuracy: You agree to provide accurate, current, and complete information during the registration process.
• Security: You are responsible for safeguarding your password and for any activities or actions under your password.
• Notification: You must notify us immediately at support@moduletrace.org of any unauthorized use of your account.
• Termination: We reserve the right to disable, suspend, or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

4. Acceptable Use Policy

You agree not to use the Services to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or otherwise objectionable.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Servers or networks connected to the Services, or disobey any requirements, procedures, policies, or regulations of networks connected to the Services.
• Attempt to gain unauthorized access to any portion of the Services or any systems or networks connected to the Services.
• Use the Services to transmit spam, chain letters, or unsolicited commercial communication.
• Upload content that infringes on any third-party intellectual property rights (e.g., submitting copyrighted code to Coderank without permission).
• Use any robot, spider, or other automatic device to monitor or copy the Services without our prior written permission.

5. User Content and Intellectual Property

5.1 Ownership

You retain all rights and ownership of the content you submit, post, or display on or through the Services ("User Content").

5.2 License to Moduletrace

By submitting User Content, you grant Moduletrace LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Services and Moduletrace's business, including for promoting and redistributing part or all of the Services.

5.3 Indemnification

You agree to indemnify, defend, and hold harmless Moduletrace LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including your User Content.

6. Paid Services and Billing

Certain aspects of the Services (e.g., premium features of Datasquirel or Coderank) may be provided for a fee.

• Billing: You agree to pay all fees associated with the Paid Services as described on the relevant service page.
• Recurring Charges: If you subscribe to a recurring service, you authorize us to charge your payment method on a recurring basis until you cancel.
• Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle. No prorated refunds will be issued for partial billing periods unless required by law.
• Changes to Fees: We reserve the right to change our fees at any time. We will provide reasonable notice of any fee changes that affect your subscription.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, MODULETRACE LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, NOR DO WE WARRANT THAT ANY SPECIFIC RESULTS (E.G., DATA RETENTION, SEARCH ACCURACY) WILL BE ACHIEVED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MODULETRACE LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR DATA USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00) IF YOU HAVE NOT PAID ANYTHING.

9. DMCA Copyright Policy

Moduletrace LLC respects the intellectual property rights of others. If you believe that any material on the Services infringes your copyright, please submit a notice to our designated Copyright Agent at copyright@moduletrace.org containing the following information:

• A physical or electronic signature of the copyright owner or authorized agent.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the infringing material and information reasonably sufficient to permit us to locate the material.
• Your contact information (address, telephone number, email).
• A statement that you have a good faith belief that use of the material is not authorized by the copyright owner.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

10. Dispute Resolution and Arbitration
